Australian Breathwork College - Terms and Conditions Agreement
This agreement outlines the terms and conditions for students participating in the Australian Breathwork College programs. We aspire to deliver the highest standards of professionalism and care. By enrolling in any course, students agree to the following:
1. Certification and Accreditation
• Mandatory Certification: Students must pass both written and practical assessments to receive certification as an Australian Breathwork College Coach or Practitioner.
• Usage of Techniques: Only certified students are permitted to facilitate sessions and workshops using Australian Breathwork College techniques and under the College's name.
• Insurance Requirement: Students must obtain Professional Indemnity Insurance through the International Institute for Complementary Therapies (IICT) or an equivalent agency before facilitating Breathwork sessions.
2. Integrity and Responsibility
• Claims and Representations: Students must not make false claims about the benefits of Australian Breathwork College techniques unless they have specific evidence to support such claims.
• Medical Disclaimer: The training does not provide medical, legal, or business advice. Students are responsible for obtaining independent advice when necessary.
• Understanding Contraindications: Students must fully understand and communicate contraindications associated with Australian Breathwork College techniques. Students must ensure that they and their participants are aware of any potential risks.
3. Student Health and Safety
• Health Declaration: Students must declare any physical or emotional conditions that may increase risks during the course. If such conditions exist, a doctor's approval is required before participation.
• Consent Forms: Consent forms/waivers must be distributed and collected before every workshop. Students are also responsible for informing participants of contraindications.
4. Ethical Conduct
• Vulnerable Participants: Students must never exploit individuals who are emotionally or physically vulnerable in any context.
• Personal Injury Responsibility: Students are advised to secure personal health insurance. Australian Breathwork College does not cover medical expenses incurred during participation.
5. Intellectual Property
• Copyright Protection: The resources, scripts, and content provided in the training are the result of over 30 years of research and development. They are intended exclusively for use by Australian Breathwork College’s licensed Breathwork Coaches and Practitioners.
• All course materials, including scripts, videos, music, and visuals, are the intellectual property of Australian Breathwork College. Reproduction, distribution, or modification of these materials without explicit written permission is strictly prohibited, including reformatting or rewriting with tools like ChatGPT.
• We request that Australian Breathwork College be acknowledged as the originator of the material, either before, during, or in footnotes. These resources must not be duplicated, shared, or published, and remain the copyrighted property of Australian Breathwork College.
• Non-Competition: Students are prohibited from using Australian Breathwork College’s intellectual property to:
o Compete with the College or other practitioners.
o Promote or sell unauthorized courses.
o Create or attempt to create financial opportunities outside of the College’s approved activities.
6. Contraindications
• Advising Clients: In cases where participants have contraindications, students must advise against using Breathwork holds and Intermittent Hypoxic Training. It is critical that students provide safe alternatives, such as 4:4 breathing techniques, which are generally suitable for all.
• Liability for Dynamic Mouth Breathing: If a participant chooses to practice Dynamic Mouth Breathing against advice, they do so at their own risk and should be supervised by a healthcare professional.
• Dynamic Mouth Breathing Sessions: We do not support or recommend conducting dynamic mouth breathing Breathwork sessions in a virtual or online setting. These sessions can evoke intense emotional trauma, and facilitating them without a trained Breathwork facilitator present is considered irresponsible. Therefore, they should never be conducted online without a trained Breathwork facilitator present.
7. Feedback and Support
• Continuous Support: Students who do not meet the required standards will receive necessary support to help them pass assessments. The College encourages open communication to address concerns and improve the learning experience.
8. Refund Policy
• Non-Refundable Fees: Once registered, participants gain access to training materials, and fees become non-refundable. However, they may transfer to another start date.
• Rescheduling Option: If a student provides notice of cancellation at least seven (7) business days before the course starts, or if they cannot continue due to unavoidable circumstances (e.g., death of a family member, illness), they may reschedule to a future course of equal value without penalty. This option is valid for six (6) months.
• Provider Cancellation: If the College cancels a course, it will be rescheduled to a later date.
